Terms of Service

These terms set out the rules you agree to follow when using DDoS Shield.

* This is a convenience translation. The Japanese version at /tos is the legally binding text; if the two differ, the Japanese version prevails.

1. Prohibited conduct

When using the service, you must not do any of the following.

• Breach these terms
• Break the laws of Japan
• Infringe copyright, likeness rights or any other right of a third party
• Impersonate another person, or supply false information
• Attempt to circumvent traffic metering, or exploit a defect or malfunction
• Interfere with the operation of our servers, network or other facilities
• Send email (including solicitations and advertising) through the service
• Publish or transmit spam, phishing or other harmful content through the service
• Damage the service or its reputation by spreading rumours, using deception, or using force
• Publish adult content through the service (this is permitted on the B2B plan)
• Anything else we judge to be inappropriate

If we confirm a breach, we may terminate your contract without prior notice.

2. Applications and re-contracting

We operate our own screening process in order to keep the service fair and safe for everyone.
Depending on the result, we may decline your application (with a refund or cancellation).

If you previously left unpaid or overdue charges with us and wish to contract again, you must first pay the outstanding amount in full together with an administrative fee of 3,300 JPY.

3. Our position on customer harassment

In line with the corporate manual on customer harassment published by Japan's Ministry of Health, Labour and Welfare, we treat the following as customer harassment.
(The list is illustrative, not exhaustive.)

• Psychological attacks (threats, intimidation, slander, defamation, insults, abusive language, attacks on a person's character)
• Damaging our reputation by spreading rumours, using deception, or using force
• Sexual harassment, stalking or comparable behaviour towards our staff, and discriminatory remarks
• Holding staff for long periods, contacting us persistently, or repeating the same request or enquiry excessively
• Using cancellation or a move to a competitor as leverage to demand excessive concessions or discounts
• Attacks on, or demands directed at, an individual member of staff
• Defaming staff on social media or elsewhere online, or invading their privacy
• Recording or filming email or telephone correspondence without permission
• Any act that damages the reputation of the company or its employees
• Entering our facilities or workspaces unlawfully, or visiting our offices without an appointment
• Demanding compensation or action without reasonable grounds
• Demanding an apology without reasonable grounds (including prostration), or demanding that staff be punished
• Demanding service that is unreasonable by ordinary social standards
• Demanding refunds, returns or compensation beyond the scope of these terms

If we identify such conduct, we will respond firmly in order to protect our staff, and where necessary we may terminate your contract and decline to deal with you further.
In particularly serious cases, or where a criminal offence is involved, we will work with the relevant police station and our legal counsel.

4. Suspension and termination of the service

We may suspend or interrupt all or part of the service without prior notice in any of the following circumstances.

• Maintenance of equipment is required
• Force majeure such as a natural disaster
• A fault or outage occurs on the network
• A public authority orders us to stop the service
• We judge it unavoidable for some other reason

We will keep any interruption to a minimum and restore the service promptly, but we accept no liability for any loss you suffer as a result of such an interruption.

5. Suspension of membership

If any of the following applies to you, we may revoke your membership and terminate the contract and the service without prior notice or demand.

If you fall behind on payment, or if your creditworthiness deteriorates significantly through seizure, legal insolvency proceedings or similar, we may revoke your membership and terminate the contract without prior notice.

• You breach these terms
• You leave charges unpaid or overdue
• Your creditworthiness deteriorates significantly through insolvency proceedings, seizure or similar
• We receive a legal request from a public authority

We accept no liability for any loss you suffer as a result of such a revocation.

6. Notices

Any notice or communication from us to you is deemed sufficient if sent by email to the address registered at the time of contract.

7. Posting on social media and blogs

You are free to share your impressions, reviews and write-ups based on actual use of the service, and as a rule we will not seek to restrict them, whether they are positive or negative.
However, where a post unfairly infringes our rights or is intended to interfere with our business, we may take appropriate legal action without prior notice, in consultation with our legal department.

8. Changes to these terms

We may revise these terms as necessary without prior notice, within the bounds of what is reasonable by ordinary social standards.
Revised terms take effect when they are published on our website.

9. Governing law and jurisdiction

These terms are interpreted in accordance with the laws and regulations of Japan.
For any dispute between you and us, you agree that the court with jurisdiction over our head office shall have exclusive jurisdiction as the court of first instance.
